Pattern Library Terms and Conditions

Understand Your Rights and Options for Exclusive and Non-Exclusive Licensing

By licensing a pattern from the Pattern Library, you agree to the following terms. These terms apply to all pattern licenses arranged through this website or via direct communication with Laura Hamzic. Please read them carefully.

1. Parties Involved

This agreement ("Agreement") is between Laura Hamzic (the "Licensor") and you, the Licensee ("Client").

2. Pending Orders & Conditional Licensing

• Payment for a pattern via the website represents an offer to license the selected Artwork.
• The license is only confirmed once the Licensee has completed the required usage form and the Licensing Agreement has been generated, signed, and returned to the Licensor.
• Until the Agreement is signed and returned, the order is considered pending, and the Licensee may cancel for a full refund by contacting the Licensor.
• Upon confirmation of the signed Agreement, the high-resolution Artwork files will be delivered as specified.

3. Usage Form / Client Details

• After purchase, the Licensee will receive a usage form via email requesting details including:
  • Business name
  • Website or social media handles
  • Intended products or applications for the Artwork
• The Licensee must complete and return this form before the Licensing Agreement is generated. Failure to provide this information may delay or prevent license approval.

4. Licensed Artwork

The Licensor grants the Licensee a license to use the selected pattern(s) (the "Artwork") for commercial purposes, subject to the specific license terms confirmed in writing between both parties.

• License details (including type, term, and usage) will be confirmed in writing prior to delivery of artwork files.
• The Licensee may only use the Artwork within the scope of the agreed terms and must not sublicense, resell, or redistribute the Artwork in any form unless explicitly permitted.

5. License Restrictions

The Licensee may NOT:

• Resell, sublicense, or redistribute the Artwork in its original or derivative form.
• Claim ownership of the Artwork or represent it as their own design.
• Use the Artwork in any way that violates copyright or intellectual property laws.

6. Copyright & Ownership

The Licensor retains full copyright and ownership of the Artwork at all times. The Licensee is purchasing the right to use the Artwork under the specified terms of this license but does not own the Artwork.

7. Territory

This license applies worldwide, unless otherwise agreed in writing.

8. File Delivery

Upon confirmation of the signed Licensing Agreement, the Licensor will deliver the high-resolution artwork files as specified in the product listing. These may include:

• High-res JPEGs
• Repeat tile formats
• Mockup images (if applicable)
• RGB files (CMYK may be requested)
• Other file formats (such as PNG, TIFF, or PSD) may be requested and will be provided based on availability.

All files are delivered digitally via email or secure download link once full payment is received, the usage form is completed, and the Licensing Agreement is signed.

9. License Fee

The Licensee agrees to pay the license fee as quoted and confirmed in writing with the Licensor. Full payment is required before any final artwork files are delivered.

10. License Renewal & Extension

The Licensee may choose to renew or extend the license upon expiration of the agreed-upon term. New fees and terms will apply for license extensions or renewals.

11. Termination

If the Licensee breaches any terms of this Agreement, the license will be terminated immediately. In such cases, the Licensee must cease all use of the Artwork, and the license is revoked.

12. Credit (Optional)

The Licensor appreciates but does not require credit for the use of the Artwork. If credit is provided, it should read: "Artwork by Laura Hamzic"

13. Indemnity

The Licensee agrees to indemnify and hold harmless the Licensor from any claims, losses, or damages that arise from the Licensee’s use of the Artwork in violation of this Agreement.

14. Limitation of Liability

The Licensor’s liability for any claim arising out of this Agreement shall be limited to the total amount paid by the Licensee for the licensed Artwork.

15. Disclaimer

• The Licensor does not guarantee any particular outcome, result, or quality from using the Artwork, including merchantability, profitability, or aesthetic outcome.
• Images of the Artwork on the website are for illustration only. Actual colours may vary due to device settings, production processes, or materials.
• The Licensee is responsible for the final application, printing, or production of the Artwork. The Licensor is not liable for any differences between the delivered digital files and the finished product.
• The Licensee acknowledges that the Licensor and Licensee operate as independent businesses. Nothing in this Agreement creates a partnership, joint venture, or agency relationship.

16. Refunds & Cancellations

• The Licensee may cancel a pending order (before signing the Licensing Agreement) and receive a full refund by contacting the Licensor.
• Once the Licensing Agreement has been signed and returned, no cancellations or refunds are available, except as required under Australian Consumer Law.

17. Amendments & Modifications

Any amendments or modifications to this Agreement must be made in writing and signed by both parties.

18. Governing Law

This Agreement will be governed by and construed in accordance with the laws of Australia.

19. Acknowledgment

By proceeding with a pattern license through the Pattern Library, you acknowledge that you have read, understood, and agreed to these Licensing Agreement Terms.
